Join us for this month's session on "Demystifying the Consent and Capacity Board: Tools for Resolving Disputes," led by Lora Patton, Vice Chair of the Consent and Capacity Board. 

Abstract 

The Consent and Capacity Board is an Ontario tribunal tasked with resolving a number of issues related to Ontario health law. Although the Board is well understood and utilized in the psychiatric context, many members of the broader health care environment are less familiar with the tools provided by legislation to resolve disputes. This discussion will highlight those tools by providing a general overview of the Board and applications available to health practitioners. 

Learning goals

  1. To explore difficult ethical and legal issues relating to consent, capacity and substitute decision-making 
  2. To identify tools available within the legislation to help resolve such conflicts 
  3. To identify when the Consent and Capacity Board can intervene in a situation to resolve conflict 

Bio

Lora Patton has been a member of the Consent and Capacity Board since 2009. A full-time Vice Chair since 2017, Ms. Patton has extensive experience adjudicating all types of applications, including the most complex and sensitive. A graduate of Osgoode Hall Law School, she was called to the Ontario bar in 1998 and later completed an MA in Critical Disability Studies. Prior to joining the Board on a full-time basis, Ms. Patton worked in social justice law and as a researcher in the areas of disability, human rights and law. She has taught courses at Osgoode Hall, York’s School of Health Policy and Management and Osgoode’s PD Health Law section (Globalization, Health and Human Rights).
