Terms of Use

These Terms of Use apply to all visitors to or users of the websites provided by Sinai Health System (being “we”, “us”, “our” and “Sinai Health”), including, but not limited to, sinaihealth.ca and lunenfeld.ca (the “Websites”). 

Your access to and use of the Websites is conditional upon your acceptance of these Terms of Use, which constitutes a legal agreement between you and Sinai Health (this “Agreement”). This Agreement should be read together with our Website Privacy Policy

BY VISITING AND USING THE WEBSITES, YOU INDICATE THAT YOU ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT AND ANY OTHER NOTICES POSTED ON THE WEBSITES. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, YOU SHOULD NOT USE ANY OF THE WEBSITES.

Sinai Health reserves the right, in its sole discretion, to modify, alter or otherwise update this Agreement at any time without prior notice or liability to you. Your continued use of the Websites following such changes will signify your acceptance of those changes.  You should visit this page periodically to review this Agreement.

General Information is Not Medical Advice

All written and other materials displayed or made available through the Websites, including any text, information, pictures, videos, data and displays (collectively, the “Material”) is provided for informational purposes only. The Websites do not provide health-care advice, diagnosis, treatment or care.

  • Note to patients and visitors:  Use of the Websites and the Material is at your own risk. You must not rely on the Material for health-care advice, diagnosis or treatment, nor use the Material to replace the advice of a health-care professional. Always seek the advice of your physician or other qualified health-care provider, licensed to practice medicine or general health care in your jurisdiction, concerning any questions you may have regarding any information obtained from the Websites and any medical condition you believe may be relevant to you or to someone else. If you require urgent help, call 911 or go to your nearest hospital emergency department.

We do not guarantee or warrant the quality, accuracy, completeness, timeliness, appropriateness or suitability of any information provided on or made available through the Websites. The Websites may contain historical Material, which is not current and is provided for your reference only. We reserve the right to modify the Material on the Websites at any time without notice or liability to you; however, we assume no obligation to update the Material, and any reliance on it will be at your sole risk.

No Physician-Patient Relationship

The presentation of general information on the Websites does not establish a physician-patient relationship between you and Sinai Health (or any of their physicians) and is not intended as a solicitation of individuals to become patients, customers or clients of Sinai Health (or any of their physicians).

Copyright and Trademarks

The Websites and the Material are protected by copyright, trademark and other laws. The content of the Websites and the Material are owned by Sinai Health, its licensors, or the party accredited as the provider of the Material. Except as granted in the limited licenses herein, any use, copying, modification, transmission, presentation, distribution, republication, or other exploitation of any of the Websites or of the Material, whether in whole or in part, is prohibited without express prior written permission. 

The display of trademarks and trade names with associated products and services on the Websites, whether owned by Sinai Health or others, does not convey or create any license or other rights in those trademarks or trade names.  Any unauthorized use of them is strictly prohibited.

You agree to comply with all applicable copyright, trademark and other laws in your use of the Websites and Material.

Permitted Use of the Websites and the Material

Subject to the terms and conditions of this Agreement, you are hereby granted a limited, non- transferable, and non-exclusive license to access, view, and use the Websites and the Material in Canada for your personal, non-commercial, educational use only.  You may not copy and/or repost online items comprising the Material.  Furthermore, you may not include any content from the Material in or with any product that you create or distribute, without the prior permission of the owner of that content. You must also abide by any additional requirements governing the use of any specific Material that may be set out in the Websites. In the event of a conflict between the terms of a license governing specific Material and this Agreement, the terms of the specific license shall govern.  

Account Registration

To access and/or use certain areas and features of the Websites, you may be asked to create an account (“Account”). If you register for an Account, you are required to: (i) provide accurate, current and complete information as may be prompted by any registration forms; (ii) protect the security of your password and not to give it to anyone that you do not want to have access to the Account; (iii) maintain and promptly update any registration data and any other information you provide; and (iv) accept all risks of unauthorized access to the registration data and any other information you provide. You are responsible for all activity under your Account. We are not responsible for unauthorized use of your Account by persons other than you. We may suspend or terminate your Account at any time without notice if we believe that you have breached a term of this Agreement, misused any of the Websites or the Material or behaved in a way that we regard as inappropriate or unlawful.

Prohibited Activities

Except as otherwise provided in this Agreement, you may not directly or indirectly: (i) use or attempt to use another person’s password, account, likeness, or other information in connection with the Websites; (ii) register an email that you do not own or do not have permission to register from the owner; (iii) post or transmit any content to the Websites that is unlawful, harmful (including any virus), threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, indecent or profane or that could constitute or encourage a violation of any law; (iv) scrape any Material from the Websites, whether automatically or manually; (v) disrupt or interfere with any other person’s use of the Websites; or (vi) attempt to obtain unauthorized access to parts of the Websites that are restricted from general access.

Use Prohibited Where Contrary to Law  

Use of the Websites is prohibited in any jurisdiction where the Websites or any of the Material may violate any laws or regulations. You agree not to access or use the Websites in such jurisdictions. You agree that you are responsible for compliance with all applicable laws or regulations. Any contravention of this provision (or any provision of this Agreement) is entirely at your own risk.

The Websites may contain links to third-party websites or references to products or services other than those of Sinai Health. These links and references are provided solely as a convenience to you and do not constitute an endorsement by Sinai Health of such websites, products or services. Sinai Health is not responsible for the content of linked third-party websites and does not make any representations regarding their accuracy, reliability or suitability for a particular purpose, or the absence of any viruses, bugs or other disabling material that may adversely affect the operation of your computer or other software. You interact with the third-party links at your own risk.

The Websites may not be linked to or from any third-party website which contains, posts, or transmits any unlawful or indecent information of any kind, including, without limitation: (i) any content constituting or encouraging conduct that would violate any law or regulation or which may be damaging or detrimental to our activities, operations, credibility, or integrity; or (ii) any website which contains, posts, or transmits any material or information of any kind which violates or infringes upon the rights of others. We reserve the right to prohibit or refuse to accept any link to the Websites, including, without limitation, any link which contains or makes available any content or information of the foregoing nature, at any time. You agree to remove any link you may have to the Websites upon request.

Disclaimer of Warranties

The Websites and the Material are provided “as is” and “as available” without representations, warranties or covenants of any kind, either express or implied, including, without limitation, no representation, warranty or covenant that: (i) the Material contained in or made available through the Websites or any item(s) made available on or through the Websites will be of merchantable quality and/or fit for a particular purpose; (ii) the Websites or Material will be accurate, complete, current, reliable, appropriate or timely; (iii) the operation of the Websites will be uninterrupted or error-free; (iv) defects or errors in the Websites or the Material, be it human or computer errors, will be corrected; (v) the Websites will be free from viruses or harmful components; and (vi) the Material does not infringe upon third party rights.  Reliance upon any information provided on the Websites is solely at your own risk.

Limitation of Liability

By viewing and using any information derived from the Websites or the Material, you hereby waive any claims, causes of action and demands, whether in tort or contract, against Sinai Health in any way related to use of the Websites or the Material or information derived from the Websites or the Material.  To the maximum extent permitted by applicable law, in no event will Sinai Health, its directors, officers, healthcare practitioners, employees, agents, licensors and their respective successors and assigns be liable for damages of any kind, including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages, or any loss or damages in the nature of, or relating to, lost business, medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, improper treatment or any loss of data, privacy breach or any other loss incurred in connection with your use, misuse or reliance upon the Websites or the Material, or your inability to use the Websites, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise.  The foregoing limitation shall apply even if we knew of or ought to have known of the possibility of such damages.

To the extent that the foregoing limitation is not permitted by applicable law, in no event will our total aggregate liability in connection with or under this Agreement exceed CA $50.

Indemnity

You agree to indemnify and hold harmless Sinai Health, its directors, officers, healthcare practitioners, employees, agents, licensors and their respective successors and assigns, from and against any and all claims, demands, liabilities, costs or expenses whatsoever, including, without limitation, legal fees and disbursements resulting directly or indirectly from your use of the Websites or your breach of this Agreement.

Termination

We may, in our sole discretion, cancel or terminate your right to use the Websites, or any part of the Websites, at any time without notice.  Such action is in addition to, and not in lieu or limitation of, any other right or remedy we may have available at law. In the event of termination, you are no longer authorized to access the Websites, or the part of the Websites affected by such cancellation or termination. The restrictions imposed on you with respect to the Material  and the disclaimers and limitations of liabilities set forth in this Agreement, shall survive termination of this Agreement. We shall not be liable to you or any third party for any such termination or discontinuance.

Applicable Law and Venue for Disputes

These Websites are controlled by us within the Province of Ontario in Canada.  These Websites can be accessed from all provinces and territories of Canada, as well as from other countries around the world.  As each of these jurisdictions has laws that may differ from those of the Province of Ontario, all matters relating to access to, or use of, these Websites, shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws principles.  You agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to your access to and use of the Websites and the Material as well as any dispute that may arise relating to them.

Enforceability of Agreement

If any provision of this Agreement is found to be unlawful, void or unenforceable, then such provision is deemed severable and will not affect the validity or enforceability of any of the remaining provisions. Sinai Health’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
